Divorce or legal separation ?

The legal grounds for divorce and separation are the same.  One key difference is in the amount of time you must have been married for.  To get divorced, you must have been married for one year or longer.  With legal separation, there is no such limitation.

A few terms defined

Petitioner – the person applying for the divorce.

Respondent – the person who has not applied for the divorce and “responds” to the petitioner’s application.

Decree Nisi – the decree which states the divorce will be legally complete after six weeks and one day.

Decree Absolute – the decree which legally finalises the divorce.

Grounds for divorce

  • Adultery.
  • The petitioner and respondent have been living separately for two years and both agree to a divorce.
  • The respondent has displayed unreasonable behaviour towards the petitioner.
  • The respondent has abandoned the petitioner for five years or longer.
