Conveyancing defined
Conveyancing, like much of ‘legalese’ (the language of the law) is an antiquated term that describes all the processes involved in the transaction of a property right or interest from one person to another.
Conveyancing is a four step process:
1. Pre-contract exchange – all the information required for the transaction needs to be gathered. Searches are conducted at this stage. Searches provide in-depth information about the property and the immediate surrounding area. Planning permissions and planned developments can be discovered through a local authority search, for example. A contract is also drafted at this stage and negotiations are undertaken if necessary. When finalised, the contract is signed by both parties.
2. Contract exchange – the seller will usually request a 10% deposit from the purchaser to ensure the sale goes through. Naturally, at this stage contracts are exchanged and a completion date is agreed on.
3. Pre-completion – prior to completion, several administrative tasks need to be undertaken. Mortgage funds, insurance, transfer documents need to be in place before the transaction is completed.
4. Completion – monies are exchanged. The purchaser is handed over the keys and possession of the property.
5. Post-completion – the property is registered at the Land Registry in the new owner’s name.
