Landlord and Tenant Act 1954
We are experts in providing both landlords and tenants advice about their duties and rights under the Landlord and Tenant Act.
Security of tenure is provided by section 24 Act where a lease is for a fixed or periodic term lasting six months or more and the premises are used for carrying out a business. Security of tenure allows you to renew a commercial lease on the same terms as before. Bear in mind that the definition extends to parts used for business only. If, for example, one half of the property is used for business and the other half is occupied for residential use, security of tenure will apply only to the business half.
Disputes often arise where leases are for a period of six months. If there is an option to renew for a further six months, making the period 12 months altogether, the Act will provide security of tenure.
We also provide landlords specific advice regarding how protection under the Act can be contracted out of. This approach requires that procedures are carefully followed. One way of achieving this under the Act is to serve notice to the tenant under section 25 prior to any application for renewal by the tenant.
