When should I draft a Power of Attorney?
At any time. The activation date can take place at a specific time. Some people use them if they know they will be away on holiday when an important document needs to be signed and processed.
Elderly clients however tend to draft a general power of attorney which has no specific activation date but is able to activated when the health of the elderly client makes it difficult for them to be fully autonomous.
Who can I appoint as my power of attorney representative(s)?
This will normally be a trusted friend or relative. You may also want to consider appointing more than one person to ensure an element of surveillance and division of power making it less likely that the position of representative will be exploited. It is a good idea to appoint a professional with a good reputation for property or financial matters for the security of knowing they have expert knowledge in managing finances and assets.
What is the application process in drafting a power of attorney?
The registration requirements to validate a power of attorney are processed by your solicitor. You will be required to pay a small £20 fee.
Once this arrangement has been made the Power of Attorney can be activated at any time or on a specified date given in the registration agreement.
What if I want to revoke the power of attorney after activation?
This is possible.
The Power of Attorney will be valid until a document revoking the power of attorney has been processed.
