Can I get divorced ?
If you have been married for longer than 12 months and one of the grounds for divorce are fulfilled, you can divorced. The grounds for divorce:
- The respondent has displayed unreasonable behaviour
- The respondent has committed adultery
- The petitioner and the respondent have been living separately for two years or longer and both parties agree to the divorce
- The respondent has abandoned the petitioner for a period of five years or longer
Who or what is “the petitioner” ?
The petitioner is the person who has applied for the divorce.
Who or what is “the respondent” ?
The respondent is the person who hasn’t applied for the divorce.
What is an acknowledgement of service ?
An acknowledgement of service is a form that is sent to the respondent. They have 14 days in which to respond. The respondent can either give or withhold their consent to the divorce.
The respondent hasn’t responded to the acknowledgement of service. What can I do ?
You can have the County Court bailiffs serve the documents in person.
Can I apply for a divorce from abroad ?
Yes you can. However, your spouse must be resident in England and Wales.
What is a contested divorce ?
A contested divorce is where the respondent disputes what is said in the divorce application.
How long will it take to get divorced ?
The answer is not set in stone. Divorces can be divided into two broad categories: contested and uncontested divorces. An uncontested divorce may take from four to six months. A contested divorce could take considerably longer.
How much will it cost to get divorced ?
Relatively simple, uncontested divorces are relatively cheap and our solicitors may be prepared to handle your case on a fixed fee basis. Contested divorces can cost considerably more.
Do I need my marriage certificate when applying for a divorce ?
Yes you do.
